This area of law is notoriously complex and is probably the most challenged area of law within the Irish Criminal Justice system. PENALTY POINTS/FIXED CHARGE PENALTY NOTICE


The Penalty Points system was initiated to ensure drivers comply with the rules of the road and to improve road safety. Penalty points are commonly received for matters such as speeding offences, using a mobile phone while driving or driving in a bus lane.

Any driver accumulating 12 penalty points within any given three-year period will be automatically disqualified from driving for six months. A lower threshold of 7 penalty points leading to disqualification applies to any driver taking out a first learner permit on or after 1 August 2014 and subsequently during the first two years while he or she is driving under a full driving licence as a novice driver.

If you do not pay your Fixed Charge Penalty Notice a Court Summons will automatically issue which will inform you of a court date to appear. Please note that there are higher penalty points imposed by the court than if you pay your Fixed Charge Penalty Notice. However, you may have a good defence to the accusation and we strongly recommend that you contact Stephen O'Mahony Solicitors.



APPEAL OF A DRIVING BAN


You may have received a driving ban following a conviction of a Road Traffic Offence for example such as Drink Driving, No Insurance or Dangerous Driving. If you wish to appeal this driving ban it is extremely important that you appeal the ban within 14 days of the conviction. RESTORATION OF A DRIVING LICENCE
